Terms and conditions

Please read all these terms and conditions.

 

As we can accept your booking and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. If you are not sure about anything just contact us.

 

Application

 

  1. These Terms and Conditions will apply to the purchase/booking of the services and goods by you (the Customer or you). We are Kingston Academy Ltd, a company registered in UK under number whose registered office is in London with email address info@kingstonacademy.co.uk; telephone number; (the Supplier or us or we).

  2. These are the terms on which we sell all Services to you. By ordering/booking any of the Services, you agree to be bound by these Terms and Conditions. You can only purchase the Services and Goods from the Website if you are eligible to enter into a contact and are at least 16 years old.

 

Interpretation

 

  1. Consumer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession.

  2. Contract means the legally-binding agreement between you and us for the supply of the Services;

  3. Delivery Location means the Supplier’s premises or other location where the Services are to be supplied, as set out in the Order;

  4. Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored;

  5. Services means the services advertised on the Website, including any face-to-face or online courses;

  6. Website means our website www.kingstonacademy.co.uk on which the Services are advertised.

 

Services

 

  1. The description of Services is as set out in the Website, catalogues, brochures or other form of advertisement.

  2. In the case of Services made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.

  3. All Services which appear on the Website are subject to availability.

  4. We can make changes to the Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

Deposits and payments

​

  1. The deposit represents 25% of the full Course price. The the deposit is the minimum amount that has to be paid when booking a Course to secure a space.

  2. The full Course price has to be paid before the start date of the Course.

  3. We allow online payments, cash payments, bank transfers, and invoice payments.

 

Customer/student responsibilities

 

  1. You must follow and complete the Registration process for a course within 24 h after booking the course on the website. Failure in completing the registration may cause your booking cancellation.

  2. You must comply with the Course payment deadline.

  3. You must follow the Course guidance and instructions provided in your email after booking a course.

  4. You must follow the relevant procedure if you wish to cancel your booking, complain, appeal, and other. You can request a detailed version of a procedure at hello@kingstonacademy.co.uk.

  5. We guarantee an appropriate learning environment where you can gain all the necessary knowledge and skills to successfully complete a qualification, however, it is your responsibility to get passing marks in the practical and written assignments.

 

Personal information and Registration

 

  1. When registering to use the Website you must set up an username and a password. You remain responsible for all actions taken under the chosen username and password and undertake not to disclose your username and password to anyone else and keep them secret.

  2. When booking a Service you must provide your complete personal details and documents in order to complete the legal requirements for the course registration.

  3. We retain and use information strictly under the Privacy Policy.

  4. We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.

Regulated Courses (Qualifications)

​

  1. Regulated Qualifications follow the rules and requirements of an awarding organisation.

  2. Our role as a training provider is to deliver the qualification according to the rules and regulations of the awarding organisation and complete the students portfolios according to the course specification.

  3. The awarding organisation is in charge of the certification of the students. The certification process can take from 3 weeks to 6 months.

Withdrawal and cancellation

 

  1. You can Cancel the Booking by telling us 48 h before the start date.

  2. Your booking will be automatically cancelled if you do not complete the Registration within 24 h after the course booking.

  3. Your booking will be automatically cancelled if you do not pay the full Course price before the course start date.

  4. Your booking will be automatically cancelled if our checks determine that you are not eligible for the Course you booked.

  5. Your booking may be cancelled for other Company internal reasons.

  6. You will be withdrawal from the course if you do not comply with the ground rules of the course including unacceptable behaviour, identification requirements, attendance, completion of distance learning materials, and other.

Refund

  1. You are eligible for 100% refund if your booking is cancelled for any of the reasons 1, 2, 4, 5 from the Withdrawal and cancellation section.

  2. You are NOT eligible for refund for any of the reasons 3 or 6 from the Withdrawal and cancellation section.

  3. You are NOT eligible for refund if you have successfully completed your course and you are waiting for results (please note that the certification for regulated  qualifications is done by the awarding organisation, NOT by the Company).

Failed assessment/examination and resit

​

  1. If you fail in any of the course assessments or examinations, the Company will make the arrangements for your resit at your convenience. Fees may apply for resits.

Privacy

 

  1. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.

  2. These Terms and Conditions should be read alongside, and in addition to our policies, including our privacy policy and cookies policy.

  3. For the purposes of these Terms and Conditions:

    → ‘Data Protection Laws’ means any applicable law relating to the processing of Personal Data, including, but not limited to the GDPR.

    → ‘GDPR’ means the UK General Data Protection Regulation.

    → ‘Data Controller’, ‘Personal Data’ and ‘Processing’ shall have the same meaning as in the GDPR.

  4. We are a Data Controller of the Personal Data we Process in providing the Services and Goods to you.

  5. Where you supply Personal Data to us so we can provide Services and Goods to you, and we Process that Personal Data in the course of providing the Services and Goods to you, we will comply with our obligations imposed by the Data Protection Laws:

    → before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;

    → we will only Process Personal Data for the purposes identified;

    → we will respect your rights in relation to your Personal Data; and

    → we will implement technical and organisational measures to ensure your Personal Data is secure.
